Frequently asked questions

Answers to common doubts about immigration paperwork, written for educational purposes.

Can I work with a tourist visa?+
No. The B-1/B-2 visa does not authorize employment in the US. To work you need a work visa or authorization (EAD).
How long does the Green Card process take?+
It depends on the category and country of origin. Immediate relatives of citizens can get it in 12-24 months, while some employment or family categories may take 5-15 years.
Can I apply for naturalization if I owe taxes?+
Normal civil debts don't disqualify, but tax non-compliance can affect the good moral character requirement. It's advisable to be current with the IRS before applying.
Do I lose my Green Card if I live abroad?+
Absences over 6 months presume abandonment of residency; over 1 year break it, unless you have a re-entry permit (Form I-131).
Can my US-citizen spouse petition me while I'm abroad?+
Yes, through consular processing: I-130 + NVC processing + interview at the consulate of your country.
What's the difference between asylum and refugee status?+
It's the same protection, but refugee status is requested outside the US, and asylum is requested while already on US soil.
Can I study with a work visa?+
Yes, generally a person in non-immigrant status can study part-time as long as they maintain their main authorized activity.
What do I do if my visa was denied?+
Ask the office for the reasons in writing, evaluate if you can fix the problem and consider consulting an immigration attorney.
